Key Issues
Things To Consider

What exactly is a way leave, and how does it affect my property rights?

How will the presence of telecommunications equipment impact my land?

What specific access rights does the operator gain through the agreement?

How long is the agreement valid, and can it be renewed or terminated?

What compensation or benefits am I entitled to for granting access?

How will installation and maintenance work affect my property?

Are there any long-term obligations or liabilities I should be aware of?

Can the terms of the agreement be negotiated to better protect my interests?

What it will cost you

Under the Code, the operator or wayleave provider is usually responsible for covering your reasonable professional fees for negotiating a wayleave agreement. Before we begin, we ensure a commitment from the operator to cover our fees. Once agreed, we manage the negotiations on your behalf, with our fees paid directly by the operator upon completion. If the initial commitment isn’t sufficient, we’ll negotiate an increase from the operator. We won’t proceed with any additional work without either their agreement or your explicit consent, ensuring you receive expert representation at no unexpected cost to you.
